The Reality and Effects of Merchant Bankruptcy in Commercial Law

Bankruptcy, in essence, is the transition from a state of financial ease to hardship, which means the inability of an individual to fulfill his financial obligations. When a person reaches this state, he is called “bankrupt,” and in the context of commercial law, bankruptcy is defined as the inability of a merchant to pay his outstanding debts. Which makes it necessary for him to declare bankruptcy. This declaration aims to liquidate his assets and properties and distribute their value fairly among creditors, in accordance with the provisions and legislation specified in the Commercial Code. This study discusses the definition of bankruptcy, its conditions and types, and its implications, in order to identify some important details in a brief and quick manner.
