Environmental Protection from a Human Rights Perspective under Islamic Law

      Abstract

      The environment is defined as the space in which living organisms live and are surrounded by a group of factors and conditions that ensure their survival and continuity of life. According to another definition, the environment includes the biosphere in which humans live, including everything that surrounds them of inanimate objects, plants, and air. The life of living organisms essentially depends on This medium must be free of pollution, or at least reduce pollution to a minimum due to the serious health damage it causes. Considering environmental protection as a human right contributes to strengthening the rule of law, as governments become directly responsible for any environmental imbalance resulting from the activities of various parties, including companies, and this contributes to achieving justice and implementing environmental laws effectively. In addition, a new right can be developed that guarantees Human beings can live in a clean and healthy environment by expanding the scope of social and economic rights to include environmental protection as part of the public interest. This transformation would consolidate the concept of living in a decent environment as a basic human right. This study deals with the environment and its elements, and the vision of the environment from a human rights perspective, and under Islamic law.
