The Legal Framework for the Use of Artificial Intelligence in Banks: An Analytical Study in Light of Saudi Regulations and International Instruments

The Saudi financial sector is undergoing rapid digital transformation within the framework of Saudi Vision 2030, particularly through the increasing adoption of artificial intelligence (AI) technologies by financial institutions subject to the supervision of the Saudi Central Bank (SAMA). Despite the numerous benefits offered by these technologies, their use raises significant legal challenges relating to data governance, transparency, and the determination of liability. These challenges require the Saudi Central Bank to develop appropriate regulatory controls and safeguards to protect banking customers.
This study aims to identify the legal requirements governing the responsible use of artificial intelligence in Saudi banks by analyzing the existing legal and regulatory framework and assessing its compatibility with relevant international instruments. The study adopts a descriptive, analytical, and comparative methodology, examining relevant Saudi laws and regulations in light of applicable international standards and instruments.
The study reaches several findings, most notably that the Saudi regulatory framework does not currently provide a standalone and unified legal framework specifically governing the use of artificial intelligence, particularly within financial institutions. Instead, Saudi banks are subject to a range of regulatory frameworks, rules, and instructions issued by the Saudi Central Bank, especially those concerning data governance, cybersecurity, risk management, and the protection of customers’ data. The use of AI is also guided by the AI Ethics Principles issued by the Saudi Data and Artificial Intelligence Authority (SDAIA), reflecting complementary regulatory oversight by SDAIA and the Saudi Central Bank, each within the scope of its respective statutory mandate. The study recommends the adoption of a unified regulatory framework governing the use of artificial intelligence in commercial banks, incorporating clear requirements relating, in particular, to AI ethics and data protection.
