Regulating Installment-Based Debt Repayment for Individual Debtors under the Saudi Enforcement Law

This study examines the legal framework governing installment-based repayment of debts by individual judgment debtors during the enforcement stage under the Saudi Enforcement Law, and assesses its adequacy in balancing effective debt recovery with the protection of bona fide debtors. The study is premised on the absence of detailed statutory regulation in the Saudi system concerning the conditions, procedures, and legal effects of judicial installment orders, in contrast with the Singaporean model, which provides a comprehensive regulatory scheme through the Debt Repayment Scheme (DRS).
Adopting an analytical and comparative methodology, the study analyzes the relevant provisions of the Saudi Enforcement Law and its Implementing Regulations, and compares them with Singapore’s insolvency framework governing the DRS. The analysis reveals that reliance on broad judicial discretion in the Saudi system, without clear statutory criteria, results in inconsistent application and delays in enforcement, thereby undermining the effectiveness of installment-based repayment as an enforcement mechanism. The study concludes by recommending the development of a more structured regulatory framework for installment repayment in Saudi enforcement proceedings, drawing on selected elements of the Singaporean experience to enhance enforcement efficiency and procedural fairness.
