The International Legal Framework for Combating Narcotic Drugs and Psychotropic Substances within the Context of Transnational Organized Crime

Abstract

This study aims to analyze the international legal framework for combating narcotic drugs and psychotropic substances, as one of the most serious forms of transnational organized crime, in light of the rapid global transformations driven by scientific and technological advancements. These developments have led to the emergence of new psychoactive substances and increasingly sophisticated methods of illicit trafficking, particularly through digital platforms. The study is grounded in the premise that, despite its cumulative development, the international legal system still faces significant challenges in effectively addressing these evolving threats.

The research seeks to clarify the legal concepts of narcotic drugs and psychotropic substances, examine the foundations of their international classification, and analyze the regulatory framework established by key international conventions, particularly the United Nations Conventions of 1961, 1971, and 1988. It further explores the legal nature of drug-related crimes and their close nexus with transnational organized crime, including their connection to money laundering and the financing of terrorism.

The study adopts a descriptive approach to present the conceptual and regulatory framework, an analytical method to interpret the provisions of international conventions and assess their legal implications, a comparative approach to identify areas of convergence and divergence among these instruments, and a critical approach to evaluate their effectiveness in addressing contemporary challenges.

The findings reveal that the international legal system is based on a dual criterion that combines the scientific assessment of a substance’s psychoactive effects with its formal inclusion in international control schedules. While the international conventions constitute a coherent legal framework integrating preventive control measures with punitive enforcement mechanisms, they exhibit relative limitations in addressing newly emerging psychoactive substances and the impact of technological developments, which have enabled criminal networks to adopt more flexible and complex operational methods.

The study concludes that enhancing the effectiveness of the international legal framework requires greater legislative flexibility, continuous updating of international classification mechanisms, strengthened international cooperation, and the incorporation of digital dimensions into global drug control strategies. Such reforms are essential to achieving a balanced legal response that integrates criminal enforcement with preventive and humanitarian considerations.
